Conditions d'utilisation
Dernière mise à jour: 2026-07-13 (brouillon)
Le contrat en langage simple entre toi et BreedQuest.
Le texte intégral du brouillon n'est disponible qu'en anglais pour l'instant ; les versions localisées suivront la relecture juridique.
The short version
- BreedQuest is free to use; BreedQuest+ is an optional subscription billed through the App Store.
- Breed identification and care features are informational — never veterinary advice. When in doubt about your pet's health, see a vet.
- Your data is yours: export it anytime, delete your account in-app.
- Be decent in community features; we remove accounts that aren't.
1. Who we are, and what these terms cover
BreedQuest ("we", "us") is operated by Viva Animali. Review: add legal entity and registered address. These terms are an agreement between you and us covering the BreedQuest iOS app, breedquest.com, and app.breedquest.com (together, the "Service"). By using the Service you accept these terms. If you don't accept them, don't use the Service.
You must be at least 13 (or the digital-consent age where you live) to create an account. The free app without an account has no age gate beyond the App Store's own rating.
2. The free app
The free app — scanning, collecting breed cards, coloring, and pet care records — runs entirely on your device with no account (see the Privacy Policy). It is supported by clearly-labeled advertising and partner ("affiliate") links: when you buy something through a link marked as a partner link, we may earn a commission at no extra cost to you. Partner links never change what the app recommends.
3. BreedQuest+ (subscription)
- BreedQuest+ adds cloud sync, the web app, and household sharing. It is billed through your Apple App Store account; pricing, renewal, trial, and refund mechanics are handled by Apple under their terms.
- Subscriptions renew automatically until cancelled in your App Store settings; cancellation takes effect at the end of the paid period.
- If BreedQuest+ lapses, your data is not deleted: it stays on your device, and synced data stays in your account (you can export or delete it at any time) — you just lose sync and web access until you resubscribe.
- We may change BreedQuest+ pricing or features with reasonable notice; changes apply from your next renewal.
4. Not veterinary advice — important
- Breed identification is a probability, not a certainty. The scanner runs a machine-learning model; it can be wrong, especially for mixed-breed dogs. Never use it as the sole basis for decisions about a dog (safety, insurance, regulation, adoption).
- Care features are informational. Reminders, routines, trends, breed care notes, and insights (e.g. weight or digestion observations) are organizational tools and general information — they are not veterinary advice, diagnosis, or treatment, and no vet-client relationship is created. Always consult a veterinarian for health concerns, and in an emergency contact a vet immediately — don't wait on an app.
- You are responsible for your pet's care, including verifying medication doses and schedules you enter into the app.
5. Your content and data
- Your data stays yours. Pets, photos, records, and notes you add belong to you. You can export everything from Profile → Export all data, and delete your cloud account from Profile → Delete account (see the Privacy Policy for retention: server erasure within 30 days).
- You grant us only the limited license needed to operate the Service: storing and transmitting your synced content to your devices, your household members, and people you explicitly share with (e.g. a care sheet or sitter link).
- Don't upload content you have no right to, or content that is illegal, abusive, or infringes others' privacy.
6. Community ("the Pack") — when available
Community features (posts, polls, meetups) come with house rules: no harassment, hate, spam, dangerous misinformation, sexual content, or posting other people's personal information; no precise home locations for pets or people. We may remove content and suspend or terminate accounts that break these rules. Report tools are built in; moderation decisions are ours to make. You keep ownership of what you post, but grant us a license to display it within the Service.
7. Acceptable use
Don't: break the law using the Service; probe, overload, or attack our systems; scrape or bulk-extract other users' data; resell the Service; reverse-engineer the app except where the law allows; or use the Service to train competing ML models from our content or other users' content.
8. Our content
The BreedQuest name, wordmark, mascots (Dex, Pixel), breed illustrations, card designs, and app content are ours or our licensors' and are protected by IP law. We give you a personal, non-transferable license to use them within the Service. Breed facts and care information are provided "as is" without warranty of accuracy.
9. Termination
You can stop using the Service anytime, and delete your account in-app. We may suspend or terminate accounts that violate these terms, with notice where practicable. On termination, sections that by nature survive (IP, disclaimers, liability limits) survive.
10. Disclaimers and liability
To the maximum extent the law allows: the Service is provided "as is" without warranties; we are not liable for indirect or consequential damages; and our total liability is capped at the greater of what you paid us in the last 12 months or €50. Nothing in these terms limits liability that cannot be limited by law (including consumer rights in the EU/UK and elsewhere). Review: verify the liability cap and consumer-law carve-outs per market.
11. Changes to these terms
We may update these terms as the product evolves. For material changes we'll give notice in the app or by email at least 30 days before they take effect; continuing to use the Service after that means you accept the new terms.
12. Governing law and contact
Governing law and venue: Review: to be chosen with counsel — likely the operator's jurisdiction, with mandatory consumer-law carve-outs. Questions: [email protected].
Companion document: Privacy Policy — the two are reviewed and published together.
